Yesterday, Ohio Attorney Cliff Arnebeck launched a new legal strategy to expose a national strategy of election manipulation directed by Karl Rove. The implications are stunning. Arnebeck has asked the Ohio Federal Court to allow for targeted under oath depositions of key individuals including Rove, Bush IT guru Michael Connell, Jack Abramoff, Ken Blackwell and others. This will be the first opportunity ever to place these individuals under oath.

Arnebeck indicated that he has amassed a great deal of information from various sources including whistleblowers implicating Rove. He wrote in yesterday's court filing that the "suspected lead perpetrator of this conspiracy against the civil rights of the plaintiffs and against the rule of law in the United States is Karl RoveŠ. Rove's politicization of the Justice Department is currently being investigation by the US House Judiciary Committee."

Arnebeck also notified both Attorney General Mukasey and the Chamber of Commerce that he intends to "assert an Ohio Corrupt Practices Act/RICO claim against Mr. Karl Rove and others based upon their activities beginning in 2000 to illegally use corporate treasury money and government power to establish single faction dominance in the United States, military dominance in the world and generally undermine the rule of law as it had developed over the course of the past century."

New evidence that Diebold fixed the GA Senate race in '02!
And the DoJ, confronted with the evidence, looked the other way.

This makes three witnesses to Diebold's perfidy--i.e., the secret placement of an
illegal software patch on the e-voting machines in two largely Democratic counties,
in order to "defeat" Sen. Max Cleland's bid for re-election.

The first was Diebold employee Rob Behler, who told his story to BlackBoxVoting,
then on Nightline and in an article by Ronnie Dugger for The Nation, before he vanished down the memory hole.

Then there was Diebold employee Chris Hood, who told the story to Robert F. Kennedy,
Jr., for the latter's major piece in Rolling Stone that came out just before the 2006elections. (Bobby's piece is included in Loser Take All.)

And now this--confirmation, and more detail, from whistle-blower Stephen Spoonamore,
who's helping out with the historic RICO lawsuit that was announced just yesterday.

So maybe Conyers et al. ought to take good hard look into that case--and all the others that Spoonamore can help them with.

And maybe now Max Cleland should pipe up! We've all been after him for years, to get
him to weigh in on his "defeat," but he has stubbornly refused to say a word about it.

GOP cyber-security expert suggests
Diebold tampered with 2002 election

A leading cyber-security expert and former delegate for Sen. John McCain (R-AZ) says he has fresh evidence regarding election fraud on Diebold electronic voting machines during the 2002 Georgia gubernatorial and senatorial elections.

Steven Spoonamore is the founder and until recently the CEO of Cybrinth LLC, an information technology policy and security firm that serves Fortune 100 companies. At a little noticed press conference in Columbus, Ohio Thursday, he discussed his investigation of a computer patch that was applied to Diebold Election Systems voting machines in Georgia right before that state's November 2002 election.

Spoonamore is one of the most prominent cyber-security experts in the country. He has security clearances from his work with the intelligence community and other government agencies, as well as the Department of Defense, and is one of the world's leading authorities on hacking and cyber-espionage.

GOP whistle-blower names Karl Rove and others in election fraud conspiracy!
Here, friends, is some news of vast importance--the beginning of a major lawsuit that will thoroughly expose Bush/Cheney's long conspiracy to steal their "victories" through election fraud.

It is a case of vast historical importance, not just because of what it will reveal about US elections since 2000, but, no less, because it represents the only way that we might actually prevent another stolen race this fall. By shining a bright light, at last, on all the topmost perpetrators of the fraud thus far, this suit will drive them all into defensive mode and, therefore, out of business.

> Connell has not only been assisting Rove on the electoral front, but also has full control of the congressional computer system. As Heller reports:

One of the more frightening aspects of Connell's work is that he created the firewall for the U.S. Congressional computer system. Of course, it is completely possible that the firewall could have been created with secret security gaps that can be exploited to hack into any congressional computer. If that has happened, every computer in any senate or congressional office is subject to hacking by Bush/Republican operatives.

(It is quite possible, in fact, that the bizarre timidity of Reid, Pelosi and most other leading Democrats may be explained as a result of BushCo having lots of dirt on all of them-- dirt gleaned freely from their emails and other on-line correspondence, all of which may well have been surveilled by Rove's own men.)

And those are just a few of the extraordinary revelations in this landmark case.

At a press conference this morning in Columbus, Ohio, Cliff Arnebeck, lead attorney for the plaintiffs in the case of King Lincoln Bronzeville v. Blackwell [3], announced that he is filing a motion to "lift the stay in the case [and] proceed with targeted discovery in order to help protect the integrity of the 2008 election."

Arnebeck will also "be providing copies of document hold notices to the U.S .Chamber Institute for Legal Reform and the U.S. Justice Department for Karl Rove emails from the White House."

This case has the potential to put some of the most powerful people in the country in jail, according to Arnebeck, as he was joined by a well-respected, life-long Republican computer security expert who charged that the red flags seen during Ohio's 2004 Presidential Election would have been cause for "a fraud investigation in a bank, but it doesn't when it comes to our vote."

WH defines contraception as abortion

White House Tries to Define Contraception As Abortion

In a spectacular act of complicity with the religious right, the Department of Health and Human Services Monday released a proposal that allows any federal grant recipient to obstruct a woman's access to contraception. In order to do this, the Department is attempting to redefine many forms of contraception, the birth control 40 percent of Americans use, as abortion. Doing so protects extremists under the Weldon and Church amendments. Those laws prohibit federal grant recipients from requiring employees to help provide or refer for abortion services. The "Definitions" section of the HHS proposal states,

Abortion: An abortion is the termination of a pregnancy. There are two commonly
held views on the question of when a pregnancy begins. Some consider a pregnancy
to begin at conception (that is, the fertilization of the egg by the sperm),
while others consider it to begin with implantation (when the embryo implants in
the lining of the uterus). A 2001 Zogby International American Values poll
revealed that 49 percent of Americans believe that human life begins at
conception. Presumably many who hold this belief think that any action that
destroys human life after conception is the termination of a pregnancy, and so
would be included in their definition of the term "abortion." Those who believe
pregnancy begins at implantation believe the term "abortion" only includes the
destruction of a human being after it has implanted in the lining of the uterus.

Journalism, by nature, is not difficult. It really isn't. Most of the key attributes for solid reporting and editing come naturally to most people; fairness, hard work, and -- most important -- common sense.

News judgment, for instance, consists mostly of editors and producers using common sense to determine, based on the limited resources at hand, which breaking events and stories should be covered, and which ones can be set aside as less important.

During the slow summer months of a presidential campaign, that judgment and that common sense is usually even easier to put into practice because, traditionally, so little happens on the campaign trail with the candidates that what ought to be covered becomes self-evident.
Yet the Beltway press corps has become so borderline dysfunctional that even the simplest tasks, such as selecting which stories to cover -- such as using common sense -- now escape most of the major players at the mainstream news organizations.

EPA Official confirms "Cover-up" directed by White House and Cheney - Boxer calls for Johnson to tell the truth

July 9, 2008 Washington, DC. In a move that has become increasingly rare among her Congressional colleagues, Senator Barbara Boxer (D-CA) today took public her call for the removal of Environmental Protection Agency Administrator Stephen Johnson if he continues stonewalling Congress, saying,"Today, I am announcing a number of actions.1) I am asking EPA Administrator Stephen Johnson to release every document related tothe Agency's finding that global warming poses a danger to the public, including bringingthe endangerment e-mail back to earth.2) EPA s hould also immediately release a strong advance notice of proposed rulemakingon global warming emissions.If Mr. Johnson refuses to do these two things -- if he does nothave the strength to do them -- he should resign. The American people need the head of theEPA to be an independent advocate for their health and their environment."Citing testimony provided by former EPA official, Jason Burnett, who "resigned from the Agency after concluding that no constructive action on global warming would take place during this Administration," Boxer went on to charge that a "cover-up is being directed from the White House and the Office of the Vice President." Don't let them steal democracy in New York!

Software-driven Optical Scanners or DREs are no way to run a democratic election. In 50% Percent of Sequoia Voting Machines Flawed Kim Zetter reports on NY's statewide failure rate of Sequoia's optical scanners, the ones most NY counties are using as Ballot Marking Devices only for 2008 but will be used to count all our votes in 2009, unless we stop them. New Yorkers are now discovering what the rest of the country has always known: software driven systems are unreliable. New York could have known; the evidence is there for the reading. Americans KNOW that their elections have been stolen

Here is an amazing editorial from the Naperville Sun in DuPage County, Illinois.
The piece itself, and the grass-roots furor that prompted it, make clear that it is
not the American people who refuse to face the facts about election fraud. It's our
thoroughly corrupt political establishment: i.e., both parties and the media (the
corporate and left/liberal press).

This column is especially significant because it comes from DuPage County, a
longtime hotbed of Republican election theft. (Those who want to know more
should Jean Kaczmarek's great essay, "The Fate of Tammy Duckworth," in
Loser Take All.) Clearly lots of people there have had enough of it.

Election commission is challenged to explain voting machine accuracy

"With all the mechanical improvements they have in the way of adding machines, and counting machines, they can't seem to invent anything to take the place of the old Political mode of counting - two for me and one for you. More people have been elected between Sundown and Sunup, than ever were elected between Sunup and Sundown." Indeed, when Will Rogers wrote that, we could not mechanize vote fraud. But now that we have things like Premier/ Diebold touch screen voting machines, votes can be stolen whether it's night or day.

Of course, it's not the machine that steals them.

Diebold machines are, as our election commission proclaims, fairly accurate. And we do not, in fact, know that any votes have ever been stolen electronically in DuPage County. All we know is that they have been stolen in other places and that, if they were to be stolen here, the design of the machines guarantees that the theft would be absolutely undetectable.

Election Defense Alliance researchers Jonathan Simon and Bruce O'Dell studied the 2006 results and found that there was a net shift of at least three million votes away from the Democratic candidates in the 2006 elections for the House of Representatives. The Democratic victory margin was shaved by 4% according this highly persuasive analysis.

Simon and O'Dell conclude:

An unidentified government official of a U.S. ally wants to participate
if and when Rep. Dennis J. Kucinich makes his case to impeach President
Bush before the House Judiciary Committee, according to the Ohio
Democrat.

The House voted, 238-180, on Tuesday to send Kucinich's latest
impeachment effort (H Res 1345) to the Judiciary Committee.

Chairman John Conyers Jr. said he will hold a broad hearing on the
general topic of abuses of power by the Bush administration.

"Mr. Curtis," said the questioner at the U.S. House Judiciary Committee proceedings, "are there programs that can be used to secretly fix elections?"

And so begins the story of Clint Curtis - computer programmer, Floridian, Republican - who was asked by the company he worked for to create a vote-rigging software prototype that he assumed would be used to try and "catch" would-be fraudsters. It was a standard "opposition research" assignment - or so he was told. The truth, of course, was something completely different and weaves into a tangled web the 2000 Presidential Election debacle, a now-sitting U.S. Congressman, and the number one threat to our national security - electronic voting.

Clint's story doesn't end with his resignation from his former company. Nor does it end with the offer of one million dollars to simply go away.

No, Clint Curtis' story ends with his taping up his hands, putting on his gloves, and a-bobbing and a-weaving right straight into that big ol' boxing ring that sits smack in the middle of the political arena.

And because he grew up thinking you're supposed to do the right thing regardless of party affiliation, Clint is still fighting to this day.

Clint Curtis knows that there are secret software programs that can be used to fix elections. How? Because he built one. And he also believes that there are people who will use these programs to try and fix elections. Why? Because he blew the whistle on one. Lastly, Clint understands that the number one threat to our democracy is electronic voting machines. Where? All over the country.

Largest ICE Raid in US History: A Personal Account

On Monday, May 12, 2008, at 10:00 a.m., in an operation
involving some 900 agents, Immigration and Customs
Enforcement (ICE) executed a raid of Agriprocessors
Inc, the nation's largest kosher slaughterhouse and
meat packing plant located in the town of Postville,
Iowa. The raid -- officials boasted -- was "the
largest single-site operation of its kind in American
history." At that same hour, 26 federally certified
interpreters from all over the country were en route to
the small neighboring city of Waterloo, Iowa, having no
idea what their mission was about. The investigation
had started more than a year earlier. Raid
preparations had begun in December. The Clerk's Office
of the U.S. District Court had contracted the
interpreters a month ahead, but was not at liberty to
tell us the whole truth, lest the impending raid be
compromised. The operation was led by ICE, which
belongs to the executive branch, whereas the U.S.
District Court, belonging to the judicial branch, had
to formulate its own official reason for participating.
Accordingly, the Court had to move for two weeks to a
remote location as part of a "Continuity of Operation
Exercise" in case they were ever disrupted by an
emergency, which in Iowa is likely to be a tornado or
flood. That is what we were told, but, frankly, I was
not prepared for a disaster of such a different kind,
one which was entirely man-made.

I arrived late that Monday night and missed the 8pm
interpreters briefing. I was instructed by phone to
meet at 7am in the hotel lobby and carpool to the
National Cattle Congress (NCC) where we would begin our
work. We arrived at the heavily guarded compound, went
through security, and gathered inside the retro
"Electric Park Ballroom" where a makeshift court had
been set up. The Clerk of Court, who coordinated the
interpreters, said: "Have you seen the news? There was
an immigration raid yesterday at 10am. They have some
400 detainees here. We'll be working late conducting
initial appearances for the next few days." He then
gave us a cursory tour of the compound. The NCC is a
60-acre cattle fairground that had been transformed
into a sort of concentration camp or detention center.
Fenced in behind the ballroom/courtroom were 23
trailers from federal authorities, including two set up
as sentencing courts; various Homeland Security buses
and an "incident response" truck; scores of ICE agents
and U.S. Marshals; and in the background two large
buildings: a pavilion where agents and prosecutors had
established a command center; and a gymnasium filled
with tight rows of cots where some 300 male detainees
were kept, the women being housed in county jails.
Later the NCC board complained to the local newspaper
that they had been "misled" by the government when they
leased the grounds purportedly for Homeland Security
training.

Echoing what I think was the general feeling, one of my
fellow interpreters would later exclaim: "When I saw
what it was really about, my heart sank. . . ." Then
began the saddest procession I have ever witnessed,
which the public would never see, because cameras were
not allowed past the perimeter of the compound (only a
few journalists came to court the following days,
notepad in hand). Driven single-file in groups of 10,
shackled at the wrists, waist and ankles, chains
dragging as they shuffled through, the slaughterhouse
workers were brought in for arraignment, sat and
listened through headsets to the interpreted initial
appearance, before marching out again to be bused to
different county jails, only to make room for the next
row of 10. They appeared to be uniformly no more than
5 ft. tall, mostly illiterate Guatemalan peasants with
Mayan last names, some being relatives (various Tajtaj,
Xicay, Sajche, Sologuei. . .), some in tears; others
with faces of worry, fear, and embarrassment. They
all spoke Spanish, a few rather laboriously. It dawned
on me that, aside from their nationality, which was
imposed on their people in the 19th century, they too
were Native Americans, in shackles. They stood out in
stark racial contrast with the rest of us as they
started their slow penguin march across the makeshift
court. "Sad spectacle" I heard a colleague say,
reading my mind. They had all waived their right to be
indicted by a grand jury and accepted instead an
information or simple charging document by the U.S.
Attorney, hoping to be quickly deported since they had
families to support back home. But it was not to be.
They were criminally charged with "aggravated identity
theft" and "Social Security fraud" -- charges they did
not understand . . . and, frankly, neither could I.
Everyone wondered how it would all play out.

US "terrorism" watch list tops 1,000,000
From the Washington Post:

The American Civil Liberties Union will announce today at the National Press Club that the U.S. government's terrorist watch list has added its 1 millionth name. The estimate stems from a Justice Department inspector general's report last year that put the watch list roster -- four years after its creation -- at more than 720,000 in April 2007, and growing by 20,000 records a month.

NY finds flaws in 50% of Sequoia's op-scans
NY: 50 Percent of Sequoia Voting Machines Flawed

New York state is in the process of replacing its lever voting machines with new voting equipment, but the state revealed recently that it has found problems with 50 percent of the roughly 1,500 ImageCast optical-scan machines (shown in the video above) that Sequoia Voting Systems has delivered to the state so far -- machines that are slated to be used by dozens of counties in the state's September 9 primary and November 4 presidential election.
Douglas Kellner, co-chair of the New York State Board of Elections, expressed frustration with the vendor, saying it appeared that Sequoia was using the state's acceptance testing process to find problems with its machines in lieu of a sound quality-control process.

"There's no way the vendor could be adequately reviewing the machines and having so many problems," he told Threat Level. "What it tells us is that the vendor just throws this stuff over the transom and does not do any alpha- or beta-testing of their own before they apply for certification testing. Then they expect that we'll identify technical glitches and then they'll correct those glitche
